For districts witnessing an unanticipated surge in ELL enrollments from recently arrived asylum seekers with school-age children, NYSED has granted an extension for the 10-day ELL identification timeline via this waiver. Further details are included below. Please reach out to the HV RBERN if you have further questions.
In response to the ongoing migrant crisis, the New York State Education Department (NYSED) is working closely with districts, schools, educators, and BOCES across the state to ensure that impacted communities have the tools and resources to best support all students.
This memo sets forth new flexibilities regarding the English language learner identification process, and explains how to complete the waiver.
More information and resources can be found on the NYSED Office of Bilingual Education and World Languages website.
LEAs are required to notify NYSED of their intent to use this flexibility through submission of the "Attestation in Support of Waiver of the ELL Identification and Placement Timeline for Recently Arrived Children and Youth" form on the NYSED Business Portal.
